Is the notice or the threat of Power Balance LLC suing my friend to be taken seriously?

One friend of mine sells Power Balance bands in ebay and he's one of those who have been shut down by eBay bec a VERO participant reported him. He got a notice from PB later demanding him to disclose his sales or they would sue him. Is this legal and should he take it seriously and reply to their demands?
